Welcome to Scrap Kabadi (Company, we, us, our). This Platform Policy explains the rules governing the use of our website, digital platform, communication channels and related services (collectively, the Platform).

Our Platform may facilitate enquiries and arrangements relating to old air conditioners, used ACs, AC scrap, AC pickup, AC collection, AC valuation and related requirements.

The Platform is designed to make AC-related enquiries and service arrangements more convenient through digital communication. Depending on the particular service, the Platform may enable users to:

2. Platform Role

3. Independent Vendors and Service Partners

Certain activities may involve independent vendors, pickup partners, logistics providers, technicians, recyclers, contractors or other service providers. Where applicable, these parties may perform services independently or on behalf of the relevant business arrangement. Such parties may remain responsible for their own:

  • Personnel
  • Equipment
  • Vehicles
  • Technical work
  • Conduct
  • Licences
  • Permissions
  • Representations
  • Employees
  • Subcontractors
  • Legal compliance

The Company may establish requirements for partners, but independent third parties remain responsible for their own acts and omissions to the extent provided by applicable law and contractual arrangements.

4. User Eligibility

Users must provide information that is accurate and sufficient for the relevant enquiry. Where a transaction involves the sale, transfer or disposal of property, the user must have the necessary authority to offer that property. The Platform must not be used by a person who is attempting to sell or transfer property without lawful authority. Where required, the Company may request additional information to verify a transaction.

5. Accurate Information Requirement

Customers and vendors must provide truthful and accurate information. This includes information relating to:

  • Name
  • Contact details
  • Location
  • AC type
  • Brand
  • Model
  • Quantity
  • Condition
  • Installation status
  • Ownership
  • Components
  • Payment information
  • Pickup requirements

Providing incomplete or misleading information may affect the availability, valuation, pickup arrangement or completion of a transaction.

6. AC Ownership

Users must not submit an AC for sale, pickup, collection or disposal unless they:

  1. Own the AC; or
  2. Have appropriate authority from the owner.

Where the AC belongs to a company, landlord, employer, institution or another person, the user may be required to demonstrate appropriate authority. The Company may refuse or place a transaction on hold where ownership or authority appears uncertain.

7. Stolen or Unlawfully Obtained ACs

The Platform must not be used for stolen, unlawfully obtained, fraudulently acquired or disputed property. If credible information indicates that an AC may be connected to unlawful activity, the Company may:

  • Suspend the request
  • Cancel the request
  • Request additional information
  • Preserve relevant records
  • Restrict Platform access
  • Contact the relevant parties
  • Cooperate with lawful authorities
  • Take other lawful action

8. AC Condition Disclosure

Users should accurately disclose the condition of their AC. Relevant information may include whether the AC is:

  • Working
  • Partially working
  • Non-working
  • Damaged
  • Dismantled
  • Incomplete
  • Missing components
  • Installed
  • Already removed
  • Physically damaged

Photographs should represent the AC fairly and should not intentionally hide material defects.

9. Photographs and Product Information

Users may be asked to provide photographs of the AC. Photographs should be:

  • Recent
  • Clear
  • Relevant
  • Representative of the actual unit

Users must not knowingly upload fake photographs, manipulated photographs, photographs of another AC, stolen photographs, fraudulent documents or unlawful material. The Company may use submitted photographs for assessment, support, verification, transaction records, dispute resolution and fraud prevention, subject to the Privacy Policy.

10. Indicative Valuation

Any price, estimate or valuation communicated before physical inspection or final verification may be indicative. An estimate may change where the actual AC differs materially from the information supplied. Factors affecting valuation may include:

  • Type
  • Brand
  • Model
  • Capacity
  • Age
  • Condition
  • Components
  • Weight
  • Quantity
  • Location
  • Market conditions
  • Pickup requirements

Unless expressly confirmed otherwise, an indicative amount should not be treated as an unconditional guaranteed price.

11. Final Assessment

Where an assessment or verification is required, the final decision may depend on the actual condition and characteristics of the AC. A photograph or customer description may not reveal every relevant issue. If material differences are identified during verification or collection, the transaction may be reconsidered according to the applicable terms.

12. Pickup Arrangements

A pickup request does not necessarily mean that collection is automatically guaranteed. Pickup may depend on:

  • Location
  • Availability
  • AC type
  • Quantity
  • Accessibility
  • Installation status
  • Service requirements
  • Vendor availability
  • Operational conditions

A pickup becomes confirmed only when the applicable confirmation has been communicated through the designated process.

13. Pickup Address

Users are responsible for providing an accurate pickup address. Incorrect or incomplete information may result in delay, failed pickup, rescheduling, additional operational requirements or cancellation. Users should inform the Company in advance about access restrictions that may materially affect the pickup.

14. Building and Property Access

Users must ensure that the relevant property permits the requested pickup or collection activity. This may include compliance with society rules, building security, parking restrictions, entry requirements, property-owner permissions and commercial-site requirements. The Company or its service partners may refuse or reschedule a pickup where lawful access is unavailable.

15. Installed ACs

If an AC is installed, the user must disclose this before collection. Installed ACs may require specialist dismantling. Unless specifically confirmed, a standard pickup should not be assumed to include AC dismantling, electrical work, refrigerant recovery, special lifting equipment, crane arrangements, wall repair, civil work or restoration work. Any additional service should be separately confirmed where applicable.

16. Safety Requirements

Users must not instruct unqualified persons to perform unsafe dismantling or electrical work. The Company may refuse a collection where site conditions appear unsafe. Safety considerations may include height, electrical connections, outdoor unit accessibility, structural conditions, restricted spaces, heavy lifting, special equipment and building access. The Company reserves the right to postpone or refuse unsafe work where reasonably necessary.

17. Customer Property

Customers should remove personal belongings and unrelated property before handover. The Company and relevant service providers should not be expected to identify or safeguard unrelated personal belongings left with an AC. Users should inspect the AC and surrounding area before collection.

18. Data and Smart AC Devices

Some modern ACs may be connected to mobile applications, smart-home systems, Wi-Fi networks, user accounts, voice assistants or digital controllers. Users should disconnect personal accounts and remove personal information before transferring an AC where applicable. The Company is not responsible for personal data that a user fails to remove from their own connected devices or accounts, subject to applicable law.

19. Payment Rules

Users should use only the payment methods or payment instructions officially communicated through the Platform. Users should not rely on unofficial payment requests. Payment evidence may be verified through available transaction records. Screenshots or messages alone may not constitute final confirmation of payment.

20. Fraudulent Payment Evidence

Submitting false or manipulated payment evidence is prohibited. This includes edited screenshots, fake receipts, false transaction numbers, misleading payment confirmations and repeated claims for the same transaction. The Company may investigate suspected payment fraud and may suspend related activity.

21. No Sharing of Banking Credentials

Users must never provide UPI PIN, ATM PIN, banking password, card PIN, internet banking password or card security credentials. The Company does not require these credentials for ordinary AC enquiries or transactions. If anyone requests such information while claiming to represent the Company, users should immediately stop and verify the request through an official channel.

22. Vendor Responsibilities

Vendors and service providers using or receiving enquiries through the Platform must:

  • Provide accurate information
  • Act lawfully
  • Respect customers
  • Follow agreed service requirements
  • Protect customer information
  • Avoid unauthorised use of customer data
  • Avoid misleading representations
  • Follow safety requirements
  • Maintain appropriate records
  • Comply with applicable law

A vendor must not use customer information for unrelated purposes without an appropriate lawful basis.

23. Vendor Conduct

Vendors must not:

  • Harass customers
  • Threaten customers
  • Demand unauthorised payments
  • Misrepresent prices
  • Misrepresent Company policies
  • Impersonate Company personnel
  • Collect unnecessary personal information
  • Use customer data for unauthorised marketing
  • Attempt to bypass Platform safeguards
  • Facilitate unlawful transactions

Violations may result in suspension, termination or other appropriate action.

24. Customer Conduct

Customers must communicate honestly and respectfully with Company personnel and service partners. Customers must not:

  • Provide false information
  • Threaten staff or vendors
  • Submit fraudulent complaints
  • Manipulate evidence
  • Create fake bookings
  • Attempt to obtain services through deception
  • Misuse promotional benefits
  • Upload unlawful content
  • Attempt unauthorised system access

25. Off-Platform Transactions

Users should exercise caution if a vendor or third party asks them to move a transaction outside the Platform. The Company may not be able to monitor, verify or support arrangements conducted independently outside its authorised systems. If a customer or vendor voluntarily conducts a transaction outside the Company’s authorised process, the Company may have limited ability to verify the transaction or resolve resulting disputes. Nothing in this clause excludes any responsibility imposed by applicable law.

26. Bypassing the Platform

Users must not intentionally use information obtained through the Platform to circumvent applicable commercial arrangements, security procedures or contractual restrictions. This may include attempts to bypass authorised payment procedures, misuse vendor/customer contact information, circumvent Platform controls, create duplicate fraudulent enquiries, manipulate commissions or fees, or avoid agreed contractual obligations. Where applicable, such conduct may result in account restriction or contractual remedies.

27. Cancellation and Rescheduling

Cancellation and rescheduling are governed by the applicable Cancellation Policy and any terms communicated during the booking process. Users should review those terms before confirming a request. Where a cancellation charge is applicable, it should be disclosed through the relevant booking or policy process.

28. Failed Pickup

A pickup may fail or be delayed for reasons including:

  • Incorrect address
  • Customer unavailable
  • AC unavailable
  • Access restriction
  • Site safety issue
  • Material difference in product information
  • Vendor unavailability
  • Operational disruption
  • Weather or emergency circumstances
  • Other circumstances outside reasonable control

Where appropriate, the Company may offer rescheduling or another available resolution.

29. Disputes

If a dispute arises between a customer and a vendor, the Company may review available information. Relevant evidence may include booking details, messages, photographs, payment records, pickup records, appointment records, call records where lawfully maintained, customer submissions and vendor submissions. The Company may facilitate communication but is not automatically responsible for every disagreement between independent parties. Applicable legal rights remain unaffected.

30. False Claims and Manipulated Evidence

Users must not submit fabricated photographs, videos, receipts, payment screenshots, ownership documents, booking information, damage claims or identity information. Where credible evidence suggests deliberate manipulation, the Company may investigate and take appropriate action.

31. Complaints

Genuine complaints are welcome. A complaint should ideally include:

  • Name
  • Contact number
  • Booking/reference number
  • Date
  • Location
  • Description
  • Photographs
  • Transaction information
  • Supporting evidence

Providing accurate information allows the Company to review the issue more effectively.

32. Malicious or Abusive Use

The Company may take appropriate action against repeated or deliberate misuse of the Platform. This may include fake complaints, threatening behaviour, harassment, fraud, abuse of staff, repeated false bookings, deliberate disruption, unauthorised access, manipulation of Platform systems. Action may include warnings, restrictions, suspension, termination or lawful reporting.

33. Account Suspension

Where the Platform provides accounts or registered profiles, the Company may restrict or suspend access where reasonably necessary because of suspected fraud, security concerns, false information, unlawful activity, repeated policy violations, abuse, payment disputes, misuse of customer/vendor information, or legal requirements. Where appropriate and legally permissible, the affected user may be informed of the reason for the restriction.

34. Platform Security

Users must not attempt to hack the Platform, circumvent security, access restricted areas, introduce malware, scrape data unlawfully, interfere with servers, manipulate Platform records, reverse engineer restricted systems, or abuse technical vulnerabilities. Suspected security incidents may be investigated and reported where appropriate.

35. Third-Party Technology

The Platform may rely on external technology providers for hosting, analytics, communication, payments, maps, security, notifications, customer support and other technical functions. Third-party systems may occasionally experience outages, errors or interruptions beyond the Company’s reasonable control.

36. Service Availability

We aim to maintain reliable Platform availability, but we do not guarantee uninterrupted access. The Platform may temporarily become unavailable due to maintenance, technical failures, security incidents, network problems, third-party outages, power failures, natural events, government restrictions or emergency situations.

37. Third-Party Content

Information supplied by customers, vendors or other users may not always be accurate. The Company may review information where appropriate, but users should not assume that every user-submitted statement has been independently verified.

38. Company Communications

Users should rely on official communication channels for important transaction information. The Company is not responsible for unauthorised communications made by individuals falsely claiming to represent the Company. If a communication appears suspicious, users should verify it through the official contact information published on the Platform.

39. Protection of Customer Information

Users and vendors receiving customer information through the Platform must use that information only for authorised purposes. Unauthorised selling, sharing, publishing, marketing, contacting, copying or distributing customer information may be prohibited and may result in appropriate action. 40. Commercial and Bulk Transactions

Bulk AC requirements may be subject to additional verification. The Company may request business details, quantity, property information, ownership confirmation, photographs, pickup conditions, authorisation and supporting documentation. Commercial transactions may have separate commercial terms.

41. Environmental and Legal Compliance

Where AC collection, dismantling, recycling or disposal involves regulated activities, the relevant parties must comply with applicable environmental, waste-management, safety and other legal requirements. Users must not request the Platform to facilitate unlawful disposal, handling or movement of regulated materials. Where applicable, the Company may work with appropriate service providers or authorised entities.

42. Restricted and Prohibited Activities

The Platform must not be used for:

  • Stolen property
  • Fraud
  • Money laundering
  • Identity theft
  • Impersonation
  • Unauthorised transactions
  • Cyber abuse
  • Harassment
  • Threats
  • False documentation
  • Payment fraud
  • Unlawful disposal
  • Unauthorised collection
  • Misuse of personal information
  • Any activity prohibited by applicable law

43. Limitation of Platform Responsibility

To the maximum extent permitted by applicable law, the Company will not be responsible for losses arising solely from:

  • False information supplied by a user
  • Independent third-party misconduct
  • Unauthorised conduct by a vendor
  • Transactions conducted outside authorised Company systems
  • User failure to follow disclosed instructions
  • Third-party platform failures
  • Unavoidable operational interruptions
  • Events beyond reasonable control
  • Unlawful acts independently committed by another party

This provision does not exclude or limit any liability that cannot legally be excluded.

44. No Blanket Disclaimer

Nothing in this Platform Policy is intended to:

  • Remove statutory consumer rights
  • Exclude mandatory legal liability
  • Prevent lawful complaints
  • Restrict access to legal remedies
  • Override applicable data-protection rights
  • Exclude liability for the Company’s own unlawful conduct

Any limitation contained in this Policy applies only to the extent legally permitted.

45. Indemnification

To the extent permitted by applicable law, a user or vendor who causes loss, damage, claims, penalties or expenses through their own unlawful conduct, fraud, deliberate misrepresentation, misuse of the Platform or infringement of another person’s rights may be responsible for the resulting consequences. This provision does not apply to the extent prohibited by applicable law.

46. Records and Audit Trail

The Company may maintain records relating to Platform activity for legitimate operational, security, legal, accounting and dispute-resolution purposes. Such records may help establish what was requested, when it was requested, what information was provided, what communications occurred, what payment status was recorded, what pickup arrangements were made and what complaints were submitted. Records will be handled in accordance with applicable law and the Privacy Policy.

47. Cooperation With Authorities

Where legally required or reasonably necessary for lawful investigations, the Company may cooperate with police, courts, government authorities, regulatory bodies, law-enforcement agencies and other competent authorities. Relevant information may be disclosed where permitted or required by applicable law.

48. Policy Changes

We may update this Platform Policy from time to time to reflect changes in law, new services, new technology, new business arrangements, security requirements, vendor processes, Platform changes or regulatory developments. The latest version published on the Platform will indicate the applicable update date. Where legally required, additional notice may be provided.

49. Severability

If any provision of this Policy is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law. The invalid provision will be interpreted or modified only to the minimum extent necessary to make it legally enforceable, where permitted.
