Terms and Conditions

Welcome to Scrap Kabadi (referred to as “Company”, “we”, “us”, or “our”).

These Terms & Conditions (“Terms”) govern your access to and use of https://scrapkabadi.in, together with any related website features, enquiry forms, communication channels, pickup arrangements and services offered through or in connection with the Platform.

The Platform facilitates services relating to old ACs, used ACs, AC scrap, AC pickup, AC collection, AC valuation, commercial AC collection and related services.

By accessing, browsing, submitting an enquiry, requesting a pickup, communicating with us, or otherwise using the Platform, you acknowledge that you have read and understood these Terms and agree to comply with them. If you do not agree with these Terms, please do not use the Platform.

1. Important Notice

Please read these Terms carefully before using the Platform. These Terms are intended to establish clear expectations regarding:

Additional terms may apply to specific services, transactions or promotional offers. Where additional terms are expressly communicated to you, those terms may apply to the relevant transaction.

2. Definitions

For these Terms:

  • “Company” means Scrap Kabadi (legal entity name as per applicable registration).
  • “Website” means https://scrapkabadi.in and its related pages and functionality.
  • “Platform” means the Website and related digital or communication channels operated or authorised by the Company.
  • “Customer”, “User”, “You” or “Your” means any person accessing or using the Platform.
  • “AC” means an air conditioner or related equipment submitted for enquiry, valuation, pickup, collection or other service.
  • “Vendor” means an independent seller, buyer, pickup partner, service provider, contractor, recycler, logistics provider or other third party associated with a service.
  • “Pickup” means the physical collection or attempted collection of an AC from the location provided by the Customer.
  • “Transaction” means an agreed service, collection, purchase, sale, payment or other arrangement facilitated through the Platform.

3. Eligibility

You must provide accurate information when using the Platform. Where an AC is being sold, transferred, collected or disposed of, you must have the legal right or appropriate authority to do so.

If you are acting on behalf of a company, employer, landlord, institution, society, organisation or another person, you represent that you have appropriate authority to make the relevant request. The Company may request reasonable information or documentation where necessary.

4. Acceptance of Terms

By using the Platform, you agree to:

  1. Provide accurate information;
  2. Use the Platform lawfully;
  3. Respect Company personnel and service partners;
  4. Follow applicable safety instructions;
  5. Provide lawful access to the AC where required;
  6. Follow payment and transaction procedures;
  7. Comply with these Terms;
  8. Comply with applicable law.

If you disagree with any material part of these Terms, you should discontinue use of the Platform.

5. Nature of the Platform

The Platform is intended to make AC-related enquiries and service arrangements convenient. Depending on the service, the Company may act as: platform operator; enquiry facilitator; service coordinator; pickup coordinator; customer-support provider; communication intermediary; or transaction facilitator.

The Company’s role may vary depending on the specific service. The Company should not automatically be treated as the owner, seller, buyer, transporter, technician or independent contractor responsible for every activity performed by a third party.

6. Independent Vendors and Service Partners

Some services may involve independent vendors, pickup partners, logistics providers, technicians, recyclers or contractors. Such parties may be independently responsible for their own personnel, vehicles, equipment, technical work, representations, licences, permissions, safety practices, employees, subcontractors and legal obligations.

The Company may impose operational requirements on service partners, but no third-party relationship should be interpreted beyond the actual arrangement applicable to that service. Nothing in these Terms excludes liability that cannot legally be excluded.

7. AC Ownership

You must not submit an AC for sale, pickup, collection or disposal unless you own it or have lawful authority from its owner. If ownership is unclear, disputed or reasonably questioned, the Company may request additional information or place the transaction on hold. The Company may refuse a transaction where satisfactory authority cannot be established.

8. Stolen or Unlawfully Obtained Property

The Platform must not be used to sell, transfer or arrange collection of stolen ACs, fraudulently obtained property, property obtained through deception, property subject to an unresolved ownership dispute, or property offered without authority.

If credible information indicates that an AC may be connected with unlawful activity, the Company may suspend the transaction, cancel the request, request documentation, preserve records, restrict Platform access, contact relevant parties, or cooperate with lawful authorities.

9. Accurate AC Information

You are responsible for providing accurate information about the AC. This may include brand, model, type, capacity, quantity, age, working condition, physical condition, installation status, missing parts, accessories, location, and ownership. Providing inaccurate information may affect the final valuation, pickup arrangement or transaction.

10. Photographs

The Company may request photographs to understand the AC and its condition. Photographs should accurately represent the actual AC. You must not intentionally submit fake photographs, photographs of another AC, manipulated images, misleading images, stolen photographs, or false documents.

The Company may use submitted photographs for assessment, customer support, records, fraud prevention and dispute resolution in accordance with its Privacy Policy.

11. AC Valuation

Any price or valuation communicated through the Platform may be indicative, preliminary, or subject to verification, unless expressly confirmed otherwise. The final value may depend on the actual AC and circumstances at the time of assessment or collection. Factors may include condition, brand, model, capacity, age, components, weight, quantity, market conditions, location, accessibility, and collection requirements.

12. Price Confirmation

A preliminary estimate does not necessarily constitute final acceptance. Where the actual AC materially differs from the information provided, the Company or relevant service provider may revise the proposed transaction in accordance with the applicable terms. Any final amount should be confirmed through the authorised transaction process.

13. Market Price Changes

AC scrap and used-equipment values may change due to market conditions. Pricing may be affected by scrap market rates, commodity prices, demand, location, transportation, condition, weight, quantity, and processing costs. A previous quote does not automatically guarantee the same amount for a future transaction unless expressly confirmed.

14. Pickup Request

Submitting a pickup request does not automatically guarantee collection. Pickup may depend on service availability, location, AC type, quantity, accessibility, vendor availability, operational conditions, and safety requirements. A pickup should be treated as confirmed only when the Company or authorised service provider confirms it through the applicable process.

15. Pickup Address

You are responsible for providing a correct and complete pickup address. You should provide relevant access information, including building number, floor, lift availability, parking restrictions, society requirements, security procedures, entry instructions, and access limitations. Incorrect information may result in delay, rescheduling or an unsuccessful pickup.

16. Installed ACs

An installed AC may require specialised dismantling. Unless expressly agreed, a normal pickup should not automatically be interpreted as including dismantling, electrical disconnection, refrigerant recovery, special lifting, crane services, wall repair, civil work, electrical repair, or restoration work. Additional charges or arrangements may apply where separately disclosed and agreed.

17. Safety

The Company and its service partners may refuse or postpone work where conditions appear unsafe. Safety concerns may include working at height, unsafe electrical connections, difficult outdoor-unit access, structural risks, heavy lifting, restricted areas, or lack of suitable equipment. Customers must not pressure personnel to perform work that they reasonably consider unsafe.

18. Customer Responsibilities During Pickup

Customers should ensure the AC is available; provide accurate information; provide lawful access; disclose relevant site conditions; remove personal belongings; follow reasonable safety instructions; and ensure necessary property permissions. The Customer remains responsible for information supplied to the Company.

19. Property and Personal Belongings

Before pickup, customers should remove personal belongings, documents, memory devices, smart-home equipment, accessories they intend to retain, and other unrelated property. The Company is not responsible for personal belongings that the Customer leaves with the AC, except to the extent required by applicable law.

20. Smart ACs and Connected Devices

If an AC is connected to Wi-Fi, mobile applications, smart-home systems, user accounts, or voice assistants, the Customer should disconnect the device and remove personal account access before handover. The Company is not responsible for personal account information that the Customer fails to remove, subject to applicable law.

21. Payment

Payments, where applicable, must be made through the authorised payment method or transaction process. The Company may use UPI, bank transfer, payment gateway, or other disclosed payment methods. Payment status may be subject to verification.

22. Payment Verification

A payment should not be considered confirmed solely because a person provides a screenshot, edited receipt, message, verbal confirmation, or unverified transaction reference. The Company may verify payment through available transaction records.

23. Confidential Payment Information

You must never disclose UPI PIN, ATM PIN, card PIN, banking password, internet banking password, or authentication credentials. The Company does not require these credentials for ordinary transactions.

24. Cancellation

Cancellation is governed by the applicable Cancellation Policy. Where a cancellation fee or other charge applies, the applicable amount and circumstances should be disclosed through the relevant policy or transaction process. Customers should review the Cancellation Policy before confirming a service.

25. Failed Pickup

A pickup may be unsuccessful because of customer unavailability, incorrect address, AC unavailable, materially different product, unsafe site, access restrictions, building restrictions, vendor unavailability, operational disruption, or force majeure. Where applicable, the Company may offer rescheduling or another available resolution.

26. Commercial and Bulk AC Transactions

Commercial or bulk transactions may be subject to additional verification. This may include company details, GST information where applicable, ownership confirmation, authorisation, quantity, photographs, site information, pickup conditions, and commercial documentation. Separate commercial terms may apply.

27. Vendor Transactions

Where a third-party vendor participates in a transaction, the vendor may be subject to separate contractual requirements. Vendors may be responsible for accurate quotations, customer communication, pickup conduct, physical handling, documentation, safety, and legal compliance. The Company’s role will depend on the specific arrangement.

28. Vendor Misconduct

The Company does not authorise vendors to misrepresent themselves, demand unauthorised payments, threaten customers, harass customers, misuse customer information, falsify transaction records, or misrepresent Company policies. Customers should report suspected misconduct promptly. The Company may investigate and take appropriate action where reasonably possible.

29. Customer Misconduct

Customers must not harass staff, threaten vendors, submit fraudulent claims, manipulate evidence, provide fake payment records, create fake bookings, misrepresent ownership, attempt to manipulate valuation, or misuse the Platform. Serious or repeated violations may result in restriction or suspension.

30. Fraud Prevention

We may take reasonable measures to detect and prevent identity fraud, payment fraud, fake enquiries, fake pickup requests, stolen property, false ownership claims, manipulated photographs, false complaints, unauthorised transactions, and Platform abuse. Where necessary, relevant information may be retained or disclosed in accordance with applicable law.

31. Off-Platform Transactions

Users should exercise caution when asked to conduct a transaction outside the authorised Platform process. The Company may have limited ability to verify the transaction, confirm payment, monitor communications, resolve disputes, or establish the agreed terms. The Company is not automatically responsible for arrangements independently made outside its authorised systems, subject to applicable law.

32. Disputes

Customers should first contact the Company regarding a transaction-related complaint. We may review booking records, communications, photographs, payment records, pickup information, vendor information, customer information, and other relevant evidence. We may facilitate communication where appropriate. Nothing in these Terms prevents a person from exercising rights available under applicable law.

33. Evidence and Records

The Company may retain transaction-related records for legitimate purposes, including customer support, security, fraud prevention, accounting, audit, dispute resolution, and legal compliance. Records may include communications, photographs, transaction information and booking details, subject to the Privacy Policy and applicable law.

34. Reviews and Feedback

If the Platform allows reviews or feedback, users must provide genuine experiences. Reviews must not contain fake claims, threats, defamation, personal information of others, malicious content, illegal content, or manipulated evidence. The Company may moderate or remove content where permitted by applicable law and Platform rules.

35. Prohibited Platform Use

You must not use the Platform to commit fraud, sell stolen property, impersonate another person, submit false documents, upload malware, attempt hacking, access restricted systems, scrape protected information unlawfully, harass users, circumvent security, facilitate unlawful transactions, or misuse personal information.

36. Website Security

You must not attempt to hack, reverse engineer restricted systems, introduce malicious code, interfere with servers, circumvent authentication, exploit security vulnerabilities, or manipulate Platform data. Security incidents may be investigated and reported where appropriate.

37. Website Availability

We aim to provide reliable access to the Website but do not guarantee uninterrupted availability. The Website may temporarily be unavailable because of maintenance, technical issues, hosting problems, network failures, security incidents, third-party failures, power outages, natural events, government actions, or other circumstances outside reasonable control.

38. Third-Party Services

The Platform may integrate with third-party services such as payment providers, WhatsApp, maps, analytics, hosting providers, communication systems, and advertising platforms. Third-party services may have their own terms and privacy policies. We are not responsible for independent third-party policies or failures except where applicable law provides otherwise.

39. Intellectual Property

Unless otherwise stated, the Website and its content may include logos, brand names, text, graphics, images, videos, designs, software, layouts, website structure, and original content. These materials may be owned by or licensed to the Company. You may not reproduce, copy, modify, distribute, sell or commercially exploit protected content without appropriate permission.

40. User-Submitted Content

If you submit photographs, reviews, comments or other material, you represent that you have the necessary rights to submit it; it does not knowingly infringe another person’s rights; it is not unlawful; it does not contain malicious code; and it does not intentionally contain false information. The Company may use submitted material for legitimate Platform operations, support, moderation and transaction-related purposes subject to applicable law and the Privacy Policy.

41. Privacy

Personal information is handled according to our Privacy Policy. By using the Platform, you acknowledge that personal information may be processed for legitimate purposes described in that policy. The Privacy Policy forms an important part of these Terms.

42. Data Protection

We aim to process personal information responsibly and in accordance with applicable law. The Digital Personal Data Protection Act, 2023 provides the legal framework for processing digital personal data and recognises individual data-protection rights alongside lawful data processing. The applicability and commencement of specific provisions should be determined according to the notifications and implementation framework in force at the relevant time.

43. Consumer Rights

Nothing in these Terms is intended to remove or restrict consumer rights that cannot legally be excluded. The Consumer Protection (E-Commerce) Rules, 2020 contain requirements concerning information disclosure, grievance mechanisms and unfair trade practices, among other matters. Where mandatory consumer-protection law applies, those requirements will prevail over any conflicting contractual language to the extent required by law.

44. No Unlawful Exclusion of Liability

The Company does not intend to exclude liability that cannot legally be excluded. Any limitation of responsibility in these Terms applies only to the maximum extent permitted by applicable law. Nothing in these Terms should be interpreted as removing statutory rights, preventing a lawful complaint, excluding mandatory liability, or removing legally available remedies.

45. Limitation of Liability

To the maximum extent permitted by applicable law, the Company will not be responsible for losses arising solely from false information provided by a Customer; false information provided by a Vendor; independent third-party misconduct; unauthorised acts of another person; transactions conducted outside authorised systems; user failure to follow disclosed instructions; third-party platform failures; events beyond reasonable control; or unlawful conduct independently committed by another party. This clause does not apply to liability that cannot legally be excluded or limited.

46. Indemnification

To the extent permitted by applicable law, a user who causes loss, damage, claim, penalty or expense through fraud, deliberate misrepresentation, unlawful activity, misuse of the Platform, infringement of third-party rights, or violation of these Terms may be responsible for the resulting consequences. This provision is subject to applicable law.

47. Force Majeure

The Company will not be responsible for delay or failure caused by circumstances beyond reasonable control. Such circumstances may include natural disasters, floods, earthquakes, fire, severe weather, war, riots, government restrictions, strikes, epidemics or pandemics, major network failures, power failures, transportation disruptions, third-party infrastructure failures, or other extraordinary events. The Company may take reasonable steps to restore services when circumstances permit.

48. Suspension or Termination

We may suspend or terminate access to the Platform where reasonably necessary because of fraud, illegal activity, security concerns, repeated violations, abuse, false information, payment misuse, misuse of customer information, threatening behaviour, or legal requirements. Where appropriate and legally permissible, we may communicate the reason for the action.

49. Account Security

If the Platform provides account functionality, users are responsible for protecting their login credentials. You should not share passwords, share OTPs, allow unauthorised access, or use another person’s account. If you suspect unauthorised access, contact us promptly.

50. Electronic Communications

By using the Platform, you agree that communications may be provided electronically where legally permitted. Communications may include SMS, email, WhatsApp, phone, website notifications, or other digital communication. You are responsible for ensuring that the contact information you provide is accurate.

51. Marketing Communications

Where permitted by law, we may send relevant promotional communications. You may opt out of promotional communications where applicable. Essential service communications may continue, including booking updates, transaction confirmations, cancellation notices, security notices, and important legal communications.

52. Commercial Transactions

Commercial customers may be subject to additional terms relating to quantity, pricing, pickup schedules, documentation, payment, taxes, authorisation, site access, liability, and vendor arrangements. The specific commercial agreement will govern where separately executed.

53. Taxes

Applicable taxes, duties or statutory charges may apply depending on the nature of the transaction and applicable law. Where applicable, relevant tax information may be reflected in transaction documentation. Users are responsible for their own tax obligations unless applicable law provides otherwise.

54. Environmental Compliance

Where AC collection, dismantling, recycling or disposal is subject to environmental or waste-management requirements, the relevant parties must comply with applicable law. The Platform must not be used to facilitate unlawful dumping, disposal, transportation or handling of regulated materials.

55. No Guarantee of Third-Party Conduct

Although the Company may take reasonable steps to work with service partners, no screening system can guarantee that an independent third party will always behave lawfully or honestly. Accordingly, to the extent permitted by law, the Company does not guarantee independent vendor conduct, individual employee conduct of third parties, third-party statements, third-party platform availability, third-party security, or independent third-party transactions. This does not affect rights or liability that cannot legally be excluded.

56. Complaints

For a complaint, please provide your name, mobile number, email, booking/reference number, date, location, details of the issue, supporting photographs, and payment reference where relevant. We may request additional information to investigate the matter.

57. False or Malicious Complaints

We encourage genuine complaints. However, knowingly submitting fabricated evidence or deliberately false information may result in appropriate action. This does not restrict any person’s lawful right to raise a genuine complaint or seek a legal remedy.

58. Governing Law

These Terms are intended to be governed by the laws applicable in India, subject to mandatory legal rights and jurisdictional requirements applicable to the relevant transaction. Nothing in these Terms is intended to deprive a consumer of a forum or remedy that cannot legally be excluded.

59. Dispute Resolution

Where a dispute arises, the parties should first attempt to resolve the matter through customer support. Where applicable, the Company may use internal complaint handling, negotiation, mediation, or other lawful dispute-resolution mechanisms. Nothing prevents a party from pursuing a remedy available under applicable law.

60. Jurisdiction

Subject to applicable consumer-protection laws and mandatory jurisdictional requirements, legal proceedings may be subject to the courts having appropriate jurisdiction over the Company or the relevant transaction. Nothing in this clause is intended to unlawfully restrict a consumer’s statutory rights.

61. Changes to These Terms

We may update these Terms from time to time because of changes in law, regulatory requirements, new services, new technology, new Platform features, changes in business operations, or security requirements. The latest version will be published on the Website with the updated date. Where legally required, additional notice may be provided.

62. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law. The invalid provision will be interpreted or modified only to the minimum extent necessary where legally permitted.

63. No Waiver

Failure by the Company to enforce a provision immediately does not necessarily mean that the Company has permanently waived its right to enforce that provision later.

64. Entire Agreement

These Terms, together with the Privacy Policy, Platform Policy, Cancellation Policy and any applicable transaction-specific terms, constitute the applicable framework governing your use of the Platform, subject to mandatory law.

66. Final User Notice

Our goal is to make AC-related transactions and pickup arrangements simple, transparent and convenient. A safe platform requires cooperation from everyone.

Customers should provide accurate information; confirm ownership; disclose AC condition; protect payment credentials; follow pickup instructions; and keep transaction records.

Vendors and service partners should act lawfully; treat customers professionally; protect customer information; follow agreed procedures; and provide accurate information.

The Company will take reasonable measures to operate the Platform responsibly and to address suspected fraud, misuse and policy violations. However, no digital platform can completely eliminate every risk arising from independent third parties, inaccurate information, technical failures or unlawful acts by others.

These Terms are designed to establish clear rules and responsibilities while preserving rights and protections that cannot legally be excluded.
